Terms and Conditions – DBTM SMS Contest

1. The Dunia Baru The Movie Contest (“Contest”) is opened exclusively all Frenclub members of Frenclub Mobile Sdn Bhd (“Frenclub”) who are (“Contestants”):
2. a resident of Malaysia;
3. aged 18 and above (parental consent or approval from legal guardian is required for participant(s) below the age of 18 years old);
4. active mobile phone subscriber with any of the local mobile operator(s);
5. Employees of Frenclub or Grand Brilliance (“GB”), agencies (including advertising, media, event management and any vendors/suppliers related to the Contest), subsidiaries, affiliates, and all their immediate family members, are not eligible to participate in this Contest.
6. This Contest is valid from 04 February 2008 – 02 March 2008 (“Contest Period”), both dates inclusive. Frenclub reserves the right to extend the Contest duration provided if the company deems fit. However, any changes related to the Contest made will be clearly published in www.duniabaruthemovie.com. Entries received after the stipulated time will be ineligible for the prize.
7. The Contestants shall be permitted to participate in the Contest via the use of their mobile phones. To enter the Contest, the Contestant must request for questions by keying in DB and sending it to 32919. The Contestant can send in as many Contest entries as they wish. The Contestant will have to answer a set of questions which consist of a total of 3 questions.
8. The Contestant must ensure that their Contest entries are complete and accurate. Incomplete, illegible or late entries shall be disqualified. Frenclub reserves the right to reject any registration and/or entry at its sole and absolute discretion without having to assign any reasons whatsoever.
9. Each SMS sent by the Contestant will be subject to a premium charge of RM0.30. This charge is in addition to the standard SMS fee charged by the mobile phone operator.
10. Contest winners will be chosen based on the mobile number scores the correct answers in the fastest time within a set of questions. During the Contest Period, Frenclub will select 20 Contestants with all the questions answered correctly within the shortest possible time as the weekly winners.
11. Contest winners will be contacted and to be notified via Frenclub SMS to his/ her mobile phone for which the contact number shall be the number used by the Contestant for submission of the answers. Results once announced are final. Disputes or appeals will not be entertained. Full list of winners will be posted on www.duniabaruthemovie.com for reference.
12. A tie-break will take place in the event when there are more than ONE (1) Contestant have the same duration of time spent into answering all the questions received during the stipulated contest period. The ultimate winner(s) for the Contest in case of tie-break will be determined base on the highest chat usage spent during the entire Contest period.
13. There will be the following prize winners:
14. FIVE (5) Grand Prize winners per week, each winner entitled to get one (1) Dunia Baru The Movie Sound Track (Album);
15. FIVE (5) Second Prize winners per week, each winner entitled to a get one (1) Dunia Baru The Movie T-Shirt 
16. Ten (10) Third Prize winners per week, each winner entitled to get one (1) Dunia Baru The Movie Notebook 
17. The Contest winner shall be responsible for all costs in connections with perfecting his/her prize, including but not limited to transporatation fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses etc.) or fees.
18. Prizes are non-transferable and there is no cash alternative. All prizes are used/taken entirely at the risk of the winner at all times, and Frenclub excludes all warranties in connection with any prize to the extent permitted by law. Winners are responsible for any taxes, fees or charges payable in respect of any prizes awarded to them (if any).
19. Acceptance of the prize/gift constitutes permission to Frenclub and GB, and its agencies to use the winner’s name, photograph and/or preference for purposes of advertising and trade without further compensation and notice, unless prohibited by law.
20. Frenclub & GB reserves the right to substitute or replace any of the prizes with another of similar value at any time, if the stated prizes are not available due to unforeseen circumstances, without notice and all prizes are non-transferable or non-redeemable for cash.
21. By participating in the Contest, each participant agrees to be bound by these Terms and Conditions. In the event of any dispute arising from any of the Contest, the decision of Frenclub shall be final and binding. Further queries or appeals shall not be entertained.
22. Frenclub & GB shall not be liable to the participant or any other party for any loss or damage of whatsoever nature suffered by any participant or subscriber as a result of participation or non-participation in the Contest or as a result of any act or omission on the part of Frenclub. Participants undertake to keep Frenclub harmless and indemnified against any losses, damages, claims, costs and expenses which may be incurred or suffered by Frenclub due to breach of any of these terms & conditions by the participant(s) and or arising from the participation of the participant in the Contest.
23. By entering the Contest, the participant agrees to be bound by these terms & conditions. In addition to these Terms & Conditions, the rules, regulations and methods of participation of the Contest, which are set out on www.duniabaruthemovie.com, shall bind all participants in the Contest. . Notwithstanding the foregoing, Frenclub has the right to amend any part of these terms & conditions contained herein and, or, withdraw the Contest at any stage without any liability towards anyone. Failure to comply with the said Terms & Conditions, rules, regulations, instructions and methods will result in the participant being disqualified or any prize awarded to be revoked.
