Terms of Usage

1. This SHOUTOUT program (“Program”) is a joint-program brought to all Frenclub members and/or Remix-Frenlcub members exclusively by Frenclub Mobile Sdn Bhd (“FRENCLUB MOBILE”) and Utusan Karya Sdn Bhd (“Utusan”). The Program is opened exclusively all Frenclub members of FRENCLUB MOBILE and/or Remix-Frenlcub members, who are:
a) a resident of Malaysia;
b) aged 18 and above (parental consent or approval from legal guardian is required for participant(s) below the age of 18 years old);
c) active mobile phone subscriber with any of the local mobile operator(s);

1. Employees of FRENCLUB MOBILE, Utusan, and/or Mine Alesi, agencies (including advertising, media, event management, and any vendors/suppliers related to the Program), subsidiaries, affiliates, and all their immediate family members, are not eligible to participate in this Program.

2. This Program is available in MMS (MMS SHOUOUT), with effective from 15th April 2008 onwards. FRENCLUB MOBILE reserves the right to end the Program at anytime provided if the company deems fit. However, any changes related to the Program made will be clearly published in www.frenclub.com.

3. MMS SHOUTOUT:
3.1. There are TWO (2) categories of MMS SHOUTOUT as stated below:
3.1.1. My Portray (A)
3.1.2. Couple Zone (B)
3.2. Instructions: Create MMS and insert text SHOUTOUT<space>REMIX<space><Category A/B><space><Personal Message>, send to 32919. Example: SHOUTOUT REMIX A I’m cute, wanna be my fren? + MMS (photo)
3.3. Content: All your personal message(s) cannot exceed 140 characters. Abbreviation is advisable (key commands exclusive). Content of your personal message(s) cannot contain any element(s) relating to sensitive issue(s). Picture(s) submitted as part of MMS SHOUTOUT shall not exceed the size of 200KB and the picture(s) shall not carry any improper and/or indelicacy element(s). FRENCLUB MOBILE reserves the right to edit your message(s) sent as part of MMS SHOUTOUT should the company deems fit to publish.
3.4. Submission limit: There is no limit to be imposed on the count of MMS SHOUTOUT to be sent by each member.
3.5. Publication: FRENCLUB MOBILE reserves the absolute right to filter and/or select the most appropriate MMS content (picture and message) to be published. There is no guaranteed publication for all the MMS SHOUTOUT sent by the member(s). All the short listed MMS SHOUTOUT will be published in the next issue of REMIX Magazine.
3.6. Contest:
3.6.1. One winner per publication (per month), will be selected for category A and category B under clause 3.1.1 and 3.1.2. Winner under clause 3.1.1 will win a special mini figurine, to be custom-made according to the winning photo; whereas for winner under clause 3.1.2 will win a set of special couple mini figurine, to be custom-made according to the winning photo.
3.6.2. Winner(s) selection will be done by panel judges from FRENCLUB, to select the best shot with the best dedication gathered for the month. The judge’s decision is final and binding. No correspondence shall be entertained.
3.6.3. Winner(s) as stipulated in clause 3.6.1, will be notified via SMS and the winning details will be published in both REMIX magazine and Frenclub website at www.frenclub.com. Winner(s) will need to furnish their mailing address to allow for prize delivery.
3.6.4. All prizes are used/taken entirely at the risk of the winner at all times, and FRENCLUB MOBILE excludes all warranties in connection with any prize to the extent permitted by law. Winner(s) is/are responsible for any taxes, fees or charges payable in respect of any prizes awarded to them (if any).
3.6.5. Prize(s) Processing:
3.6.5.1. Collection: Winner(s) PHOTO (from Category A: My Portray and Category B: Couple Zone) and mailing address of the winner(s) collected will be emailed to Mine Alesi for figure production which will take 2 weeks to complete.
3.6.5.2. Production: Mine Alesi will courier the finished mini replica to the monthly winner(s) according to mailing address given by Frenclub Mobile.
3.6.5.3. Delivery: Monthly winner(s) will expect the replica to arrive to them not later than 30 days after the result announcement date.

4. Each MMS SHOUTOUT sent by the member will be subject to a premium charge of RM2.00. This charge is in addition to the standard GPRS fee charged by the member’s mobile service operator.

5. Acceptance of the prize/gift constitutes permission to FRENCLUB MOBILE and its agencies to use the winner’s name, photograph and/or preference for purposes of advertising and trade without further compensation and notice, unless prohibited by law.

6. FRENCLUB MOBILE reserves the right to substitute or replace any of the prizes with another of similar value at any time, if the stated prizes are not available due to unforeseen circumstances, without notice and all prizes are non-transferable or non-redeemable for cash.

7. FRENCLUB MOBILE shall not be liable to the participant or any other party for any loss or damage of whatsoever nature suffered by any participant or subscriber as a result of participation or non-participation in the Program or as a result of any act or omission on the part of FRENCLUB MOBILE. Participants undertake to keep FRENCLUB MOBILE harmless and indemnified against any losses, damages, claims, costs and expenses which may be incurred or suffered by FRENCLUB MOBILE due to breach of any of these terms & conditions by the participant(s) and or arising from the participation of the participant in the Program.

8. FRENCLUB MOBILE will not be responsible for any technical error(s) for the submission of SMS and/or MMS SHOUTOUT.

9. Through the Program participation, the member agrees to be bound by these terms & conditions. In addition to these Terms & Conditions, the rules, regulations and methods of participation of the Program, which are set out on www.frenclub.com, shall bind all members involved in the Program. Notwithstanding the foregoing, FRENCLUB MOBILE has the right to amend any part of these terms & conditions contained herein and, or, withdraw the Programs at any stage without any liability towards anyone. Failure to comply with the said Terms & Conditions, rules, regulations, instructions and methods will result in the participant being disqualified or any prize awarded to be revoked. In the event of any dispute arising from any of the Program, the decision of FRENCLUB MOBILE shall be final and binding. Further queries or appeals shall not be entertained.
