Terms and Conditions – REMIX – Frenclub SMS Quiz

1. The REMIX Quiz (“Quiz”) is opened exclusively all REMIX - Frenclub members of Frenclub Mobile Sdn Bhd (“Frenclub”) who are (“Participants”):
a) a resident of Malaysia;
b) aged 18 and above (parental consent or approval from legal guardian is required for participant(s) below the age of 18 years old);
c) active mobile phone subscriber with any of the local mobile operator(s);

2. Employees of Frenclub or REMIX, agencies (including advertising, media, event management and any vendors/suppliers related to the Quiz), subsidiaries, affiliates, and all their immediate family members, are not eligible to participate in this Quiz.

3. This Quiz is valid from 1 June to 31 August 2008 (“Quiz Period”). Frenclub reserves the right to extend the Quiz duration provided if the company deems fit. However, any changes related to the Quiz made will be clearly published in www.frenclub.com. Entries received after the stipulated time will be ineligible for the prize.

4. The Participants shall be permitted to participate in the Quiz via the use of their mobile phones. To enter the Quiz, the Participants must request for questions by keying in REMIX and sending it to 22919 ( Maxis & Celcom ) and 32919 ( Digi ). The Participants can send in as many Quiz entries as they wish. The Participants will have to answer a set of questions which consist of a total of 3 questions.

5. The Participants must ensure that their Quiz entries are complete and accurate. Incomplete, illegible or late entries shall be disqualified. Frenclub reserves the right to reject any registration and/or entry at its sole and absolute discretion without having to assign any reasons whatsoever.

6. Each Quiz related SMS sent by the Participants will be subject to a premium charge of RM0.50. This charge is in addition to the standard SMS fee charged by the mobile phone operator.

7. TEN (10) winners will be selected per month as the Quiz winners. Winners selection will be based on the mobile number scores the correct answers in the fastest time within a set of questions. During the Quiz Period, Frenclub will select TEN (10) Participants with all the questions answered correctly within the shortest possible time as the winners. Each winner will be entitled to get THREE (3) MONTH Free REMIX magazine subscription.

8. Quiz winners will be contacted and to be notified via Frenclub SMS to his/ her mobile phone for which the contact number shall be the number used by the Participants for submission of the answers. Results once announced are final. Disputes or appeals will not be entertained. Full list of winners will be posted on Remix magazine and www.frenclub.com for reference.

9. A tie-break will take place in the event when there are more than ONE (1) Participants have the same duration of time spent into answering all the questions received during the stipulated Quiz period. The ultimate winner(s) for the Quiz in case of tie-break will be determined base on the highest chat usage spent during the entire Quiz period.

10. The Quiz winner shall be responsible for all costs in connections with perfecting his/her prize, including but not limited to transportation fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses etc.) or fees.

11. Prizes are non-transferable and there is no cash alternative. All prizes are used/taken entirely at the risk of the winner at all times, and Frenclub excludes all warranties in connection with any prize to the extent permitted by law. Winners are responsible for any taxes, fees or charges payable in respect of any prizes awarded to them (if any).

12. Acceptance of the prize/gift constitutes permission to Frenclub and REMIX, and its agencies to use the winner’s name, photograph and/or preference for purposes of advertising and trade without further compensation and notice, unless prohibited by law.

13. Frenclub & REMIX reserves the right to substitute or replace any of the prizes with another of similar value at any time, if the stated prizes are not available due to unforeseen circumstances, without notice and all prizes are non-transferable or non-redeemable for cash.

14. By participating in the Quiz, each participant agrees to be bound by these Terms and Conditions. In the event of any dispute arising from any of the Quiz, the decision of Frenclub shall be final and binding. Further queries or appeals shall not be entertained.

15. Frenclub & REMIX shall not be liable to the participant or any other party for any loss or damage of whatsoever nature suffered by any participant or subscriber as a result of participation or non-participation in the Quiz or as a result of any act or omission on the part of Frenclub. Participants undertake to keep Frenclub harmless and indemnified against any losses, damages, claims, costs and expenses which may be incurred or suffered by Frenclub due to breach of any of these terms & conditions by the participant(s) and or arising from the participation of the participant in the Quiz.

16. By entering the Quiz, the participant agrees to be bound by these terms & conditions. In addition to these Terms & Conditions, the rules, regulations and methods of participation of the Quiz, which are set out on www.frenclub.com, shall bind all participants in the Quiz. . Notwithstanding the foregoing, Frenclub has the right to amend any part of these terms & conditions contained herein and, or, withdraw the Quiz at any stage without any liability towards anyone. Failure to comply with the said Terms & Conditions, rules, regulations, instructions and methods will result in the participant being disqualified or any prize awarded to be revoked.
